EventscapeManila, Inc. (the “Corporation”) is a corporation duly organized and existing under the laws of the Republic of the Philippines, with office address at 4th Floor, Valdelcon Building, #20 Jupiter Street, Bel-Air, Makati City, Philippines. It is engaged in the business of general marketing, creatives, promotions, and events production.
The Corporation respects your privacy and recognizes the need for appropriate measures to protect and manage your personal data. This Privacy Notice aims to assure our clients and other individuals that we are observing the appropriate level of personal data protection in compliance with the standards prescribed by Republic Act No. 10173, otherwise known as the “Data Privacy Act”. It sets out the basis on which the Corporation will use, disclose, or otherwise process any personal data that it collects from you or on your behalf, or that you provide, in conjunction with its terms of use and any other relevant documents.
Service Description
The Corporation specializes in general marketing, promotions and events production for and on behalf of its clientele.
Personal Information to be Collected
By using and accessing our website, you thereby consent to the processes and policies outlined in this Privacy Notice, including the collection, use, disclosure and processing of your personal data.
The following personal information may be collected from you:
- Personal contact information which includes your name, address, email address, phone number, or any other information that would allow the Corporation to contact you;
- Demographic information which includes your gender, date of birth, age, civil status, nationality, etc.;
- Non-personal information such as those provided by your device which may include your Internet Protocol (IP) address, geolocation, operating system, browser type and version, and other machine identifiers, etc.;
- Usage and transaction data, including details of your transactions, your searches, and other products and services related to you; and
- Other personal information that are uploaded on the website.
Collection Method and Timing
Your personal information will be collected, directly or indirectly, through any of the following means:
- Forms, agreements and other similar or related documents you submitted, uploaded or executed while using the website, including when registering, subscribing to services, or requesting for services;
- Registration and use of the Corporation’s website and other web-based platforms thru third party web analytics tools, including the use of cookies to collect anonymous information, and data generated in connection with your activities when you visit our network of websites;
- During availment of our services;
- Communications and correspondences with our employees, whether in writing, verbally, or thru electronic means, or through the website; and
- Personal information obtained from third parties and other sources which have obtained your prior consent for disclosure or when we are legally allowed to acquire such information.
The Corporation may use cookies, web beacons, tags, scripts, local shared objects such as HTML5, advertising identifiers and similar technologies in connection with your use of the website. It may allow third parties to use cookies on the website to collect the same type of personal information for the same purposes the Corporation does for itself. Third parties may be able to associate the personal information they collect with other personal information they have about you from other sources. The Corporation does not necessarily have access to or control over the cookies they use. Depending on the type of device and operating software that you are utilizing, you may be granted the option to deactivate these cookies.
Purpose and Use of Collected Personal Information
Your personal information is collected and processed by the Corporation for the following purposes:
- To perform its obligations and responsibilities with you and its other clients for the purpose of facilitating the services;
- To verify your identity, conduct background checks, access relevant records, and protect you and/or us from fraud;
- To assist you in all your concerns regarding its services or to respond to queries, complaints, or feedback;
- To properly manage your account, personalize customer care activities, optimize content delivery on the website, monitor quality and security of its services, train its staff, and provide services to you in a timely and efficient manner;
- To conduct research, analysis and development activities for the purpose of improving the website and enhance your experience;
- To inform you about the activities, products and services, projects, and programs of the Corporation;
- To comply with legal and regulatory requirements and perform such other processing that may be required under any applicable law or regulation; and
- To comply with legal process or a request from any governmental or regulatory authority having jurisdiction over the Corporation and to enforce its rights or this Privacy Notice.
In the course of performing its services and responsibilities, the Corporation may engage the services of third-party service providers, agents, our affiliates or related corporations, and/or other third parties. Such third parties include, but are not limited to, the following:
- The Corporation’s subsidiaries, affiliates and related corporations;
- Contractors, agents, service providers and other third parties that the Corporation use to support its business, such as payment gateways, analytics tools, and customer support providers;
- Governmental or regulatory authorities having jurisdiction over the Corporation; and
- The Corporation’s successor-in-interest in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of the Corporation’s assets.
In doing so, certain personal information is required to be disclosed for legitimate business concerns and as may be necessary to provide you with the services. The Corporation will never share, sell or otherwise disclose your personal information to third parties, except as otherwise stated above or unless otherwise permitted under the Data Privacy Law. These third-party providers are contractually required to comply with the Data Privacy Act and to use reasonable diligence in safeguarding your information.
The website may, from time to time, contain links to external sites or resources which are operated by third parties. The Corporation has no control over the content and privacy practices of such sites or resources. You are advised to review the privacy policies of these sites and resources operated by third parties and understand how your information may be used by those third parties.
Storage, Transmission and Location of Personal Information
Organizational, physical and technical security measures are maintained, enforced and implemented at all times to ensure the integrity, confidentiality and security of your personal information.
The security measures of the Corporation include, but are not limited to the following:
- The processing of personal information is limited to the extent necessary to deliver the services offered and/or made available by the Corporation;
- Its server is equipped with firewall, data encryption, anti-virus, and other appropriate security controls;
- Access to personal information is restricted to authorized personnel on a need-to-know basis;
- Regular audits are conducted to ensure that personal information is secured and security controls are effective;
- The security systems are kept up to date; and
- The personnel are regularly oriented regarding the appropriate level of data privacy protection.
Your personal information may be stored in the Corporation’s own secure on-site servers or other internally hosted technology and you shall be responsible for maintaining the confidentiality of your access credentials. It may also be stored by third parties, via cloud services or other technology, to whom the Corporation has contracted with, to support its business operations e.g. service fulfillment, payment gateways. These third parties do not use or have access to your personal data other than for cloud storage and retrieval, and the Corporation requires such parties to employ at least the same level of security that it uses to protect your personal data. Your personal information may likewise be transferred to and stored outside of the Philippines.
Retention Period
Your personal information will be retained by the Corporation until it is no longer necessary for (i) the fulfillment of the purpose/s for which it was obtained, (ii) any legal or business purposes and (iii) other legitimate interests that may warrant further retention of such personal data. Upon the cessation of the said circumstances and subject to the Data Privacy Laws, your personal information may be stored for an additional period of three (3) years for the purpose of complying with legal and regulatory requirements, after which, the data will be anonymized and utilized solely for statistical purposes. Subject to applicable laws, the Corporation may securely dispose of your personal data without prior notice to you. Note that the Corporation shall not be liable for data retention by third parties via screenshots, downloads, or other methods beyond its control.
If you do not consent to the collection and processing of your personal information, you may opt-out at any time by notifying the Corporation’s Data Protection Officer in writing. The Corporation will process such requests in accordance with this Privacy Notice and its obligations under the Data Privacy Law and other applicable laws. Note, however, that opting out or withdrawing your consent may affect your use of the website.
Rights of Data Subject
In accordance with the Data Privacy Law, we shall respect and uphold your right to be informed, to object, access, correct, to rectification, erasure and blocking, to data portability, to file a complaint, and to damages. The Corporation hereby reserves the right to amend this Privacy Notice to comply with government and regulatory requirements, to adapt to new technologies, to align with industry practices, or for other legitimate purposes. Rest assured that you will be notified if the amendments are significant. To the fullest extent permissible under applicable laws, your continued use of the website shall constitute your acknowledgment and acceptance of the changes made to this Privacy Notice.
